These Terms of Service ("Terms") govern your access to and use of the HeroByName online store and any related mobile sites, applications, or services (collectively, the "Services"). The Services are provided by SIA efficientmorning.ai, Registration No. 40203557649, VAT No. LV40203557649, registered at Krišjāņa Barona iela 130‑k9‑17, Rīga, LV‑1012, Latvia ("we", "our", "us"). By visiting our website or purchasing from us you agree to be bound by these Terms and to comply with all applicable laws.

1.  Eligibility

You must be at least 16 years old and have legal capacity to enter into a contract, or have the consent of a parent or legal guardian, to use the Services. By placing an order you represent that you meet these requirements.

2.  Ordering & Contract Formation

  1. Your order constitutes an offer to purchase. We accept your offer only when we email "Order Confirmation".

  2. We may refuse or cancel any order if we suspect fraud, stock shortages, or violation of these Terms.

  3. For physical book orders, you will receive a free PDF preview within 24 hours after payment. From the moment you receive the preview, you have 12 hours to request changes or cancellation before the order enters production (see our Refund Policy). Digital-only purchases (e.g., PDF-only products, audiobooks) are non-refundable once the digital content has been delivered or access has been provided.

3.  Pricing & Taxes

All prices are shown inclusive of Latvian VAT (currently 21%) unless stated otherwise.

For customers within the European Union, VAT is handled according to applicable EU VAT rules. The VAT rate shown at checkout may vary depending on your location and our tax registration obligations at the time of purchase.

Customers outside the EU are responsible for any local import VAT, customs duties, or handling fees, unless we explicitly offer Delivered-Duty-Paid (DDP) shipping at checkout.

4.  Payment

We accept the payment methods displayed at checkout. Payments are processed securely by Shopify Payments / Stripe. We do not store full card details.

5.  Shipping & Delivery

Shipping options, prices and estimated delivery times are displayed at checkout and further detailed in our Shipping Policy. Delivery dates are estimates; we are not liable for delays caused by the carrier or customs clearance.

6.  Intellectual Property

All content on the Services—including designs, text, graphics, logos and generated illustrations—is owned by us or our licensors and protected by intellectual‑property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7.  User Content & Licence

If you upload a photo or other content for personalisation you grant us a non‑exclusive, royalty‑free licence to use, reproduce and modify that content solely for the purpose of fulfilling your order. You represent that you have the right to grant this licence and that your content does not infringe any third‑party rights.

8.  Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or to solicit others to perform unlawful acts.

  • Upload content that is illegal, harassing, defamatory, obscene, or infringes intellectual‑property rights.

  • Interfere with or circumvent the security features of the Services.

9.  Warranties & Disclaimers

The Services are provided “as is” and “as available.” We do not warrant that the Services will be uninterrupted, timely, secure or error‑free.

10.  Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

11.  Indemnification

You agree to indemnify and hold us harmless from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third‑party right.

12.  Governing Law & Dispute Resolution

These Terms are governed by the laws of Latvia. Any dispute shall first be addressed through friendly negotiations. If unresolved, the dispute may be submitted to the Latvian Consumer Rights Protection Centre (PTAC) for out‑of‑court settlement or to the competent Latvian courts. If you reside in the EU, you may also use out-of-court dispute resolution (ADR). Information on ADR and the list of national dispute resolution bodies is available via the European Commission’s Consumer Redress website.

13.  Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force.

14.  Changes to the Terms

We may update these Terms from time to time. The latest version is posted on this page and supersedes all prior versions. Continued use of the Services after a change constitutes acceptance of the new Terms.
